We offer a range of services in the area of
medico-legal law:
- Employment and Contractual Matters: Advice and representation for PHOs over contractual issues concerning funding, working with DHBs over locum and permanent contracts for health practitioners while acting for a medical recruitment agency, General employment experience in drafting all forms of employment contracts, advice and representation to employers and employees over personal grievances, bringing and defending personal grievances, including attendance at mediation, Employment Relations Authority and the Employment Court;
- Health Practitioners Disciplinary Tribunal: We are Counsel for the Health Practitioners Disciplinary Tribunal. This involves advice to the Tribunal members and representation (in the High Court) in respect of its operations (disciplinary matters);
- Coronial Enquiries: We provide advice on the inquest process, including advising families and making representations as to when a public inquest ought to be held, representation at inquests;
- ACC – Complex Claims: Treatment injury cases for cancer misdiagnosis, Advice and representation in respect of children injured due to medical negligence during birth, ACC cover for surgical error, including maxillo-facial surgery, Sexual abuse ACC claims and mental injury cases, Chronic pain / fibromyalgia cases;
- Health and Disability Commissioner Complaints: Complaints to the Commissioner for breaches of the Code and taking claims in the Human Rights Review Tribunal for breaches of the Code;
- Exemplary Damages Claims: Advice and representation for those affected by significant medical negligence in taking claims for exemplary damages, including: significant surgical error in performing cosmetic surgery, health consumer waking during surgery, failure to provide adequate medical care during birth, deaths whilst in hospital care.
